The State vs Ian Freeman

KEENE – At 9AM on Wednesday, August 10th Ian will be on trial at the Cheshire County Superior Court. Law Enforcement arrested him over a year ago, on July 18th 2010, for standing in front of and sitting on a police car. The car was being driven by a Keene, NH Law Enforcer who was attempting to cage Heika Courser for drinking a beer in a park.

Alcohol is commonly consumed in Keene’s Central Square and cannabis is regularly smoked. On that day, however, Heika was having her breasts painted by a local artist, and this drew the attention of police.

In Iran, police enforce bans on necklaces and “celebrity” hairstyles. Other governments ban specific colors of clothing or too much clothing. Even in the land of the free law enforcers enforce bans on saggy pants.

But in Keene, going topless on a sunny day is enough to earn you the attention of the government’s law enforcers. Learning their lesson from a previous failed arrest in which female toplessness was determined to be permissible, they decided to charge Heika with drinking a beer in the park instead.

One minute she is enjoying the good weather and good friends, the next she is grabbed, chained and forced into a car. Heika’s friends weren’t going to make this easy for the people enforcing bad laws. The encounter concluded with Wes Gilreath, Ian Freeman, Smeg Mclain, and Rich Paul being arrested for peacefully standing in front of a police car.

Ian Freeman’s jury trial is at 9AM and he will attempt to appeal to the conscience of the six member jury to get them to nullify these charges. Good people break bad laws just as good jurors nullify bad laws. Let’s hope Ian has some good jurors on his side.

Ian will have many activists supporting him including Ademo Freeman who will testify about the events that took place that day.

The media has been ordered to adhere to three pages of restrictions or face contempt of court charges. The first restriction is that there will be no live streams of the trial. At a Keene Superior Court hearing on Monday a court employee threatened to break my camera. Despite these restrictions there will be updates made at CDEvolution.org.

Upcoming & Ongoing Disobedience

August appears to be a busy month for civil disobedience and I’m just talking about what has been scheduled. Disobedience is often unplanned and sometimes goes unknown or happens unintentionally. With so much arbitrary legislation being created all of the time we can’t possibly know all the laws that are on the books, and may break several throughout the course of a day without even knowing it. The following events are either planned acts of civil disobedience or court dates for good people who are on trial for breaking bad laws.

Livestream Archive of Pete & Ademo’s Trial in Greenfield, MA

The Civil Disobedience Evolution Fund sponsored the live stream broadcast by Talley.TV from Greenfield, MA on July 18th and 19th. 25 videos have been organized into a YouTube playlist which begins on the 19th with Pete and Ademo announcing their victory in front of supporters and then switches to the morning on the 18th during the “No Victim No Crime” Rally in front of the Greenfield, MA Courthouse:

Thanks to Pete Eyre, Ademo Freeman, Ian Freeman, Kathy Breidel and others for providing live updates for the hundreds of people watching the live stream.

As you may be aware, Pete Eyre and Ademo Mueller were victorious at the end of the day because they had the truth on their side (as documented by rolling video cameras) and jurors who were willing to go against the State by declaring that the two liberty activists were, indeed, “NOT GUILTY.”

Supporting Jim Johnson

The Civil Disobedience Evolution Fund’s slogan “supporting the good people who disobey bad laws” perfectly describes heroes like Jim Johnson, a man who is bravely refusing to fill out papers revealing private financial details. Judge Arnold found him in contempt of court for refusing to fill out paperwork, and Jim is now being held captive in a cage indefinitely.

Earlier today CDEF Director Brian Travis filled Jim’s commissary account on the first day of Jim’s transfer from solitary confinement into general population. A commissary is a bank type account for inmate monies and for the procurement of personal items like footwear and hygiene items.

CDEF Director Ian Freeman posted the following at FreeKeene.com from details provided by Jim’s wife, Lauren Canario:

Jim has been moved out of segregation after two weeks of being held in a small room for 23 hours per day. Jim is now in “D block” where he is able to interact with other human beings, exercise, as well as access a commissary account. Additionally, you can now visit him any day of the week between 8a-12p, 1-3:30p, and 6-10p.

Ian explains why Jim is being held:

Jim is being held at the whim of robed man John P. Arnold of the Cheshire superior court. Arnold caged Jim because Jim refused to fill out a court form. Arnold calls it “contempt”. There is no date of release for Jim. There is no way that I am aware of to hold “judge” Arnold accountable for his actions.

Jim is in jail either for refusing to give government money they demand, or for refusing to tell government about his personal finances. Send Jim a letter by clicking here, or a postcard by clicking here.

Jim refused to pay a fine demanded by government and the judge demanded that Jim fill out paperwork that would reveal his personal finances. Jim refused the paperwork and the judge had him locked in a cage. He is being held “indefinitely:” i.e., until the judge becomes humane, or until Jim submits to their demands to fill out their paperwork revealing his personal finances.

Here is the Free Keene video showing Jim’s “contempt of court.” With the definition of justice being perverted by men in robes like Arnold, who wouldn’t have contempt?

Video: Beau Davis Defying Judge and the Response

CD Evolution Director Ian Freeman posted the following video and blog post at FreeKeene.com which details the outrageous behavior by employees of the Keene District Court that resulted in the caging of our peaceful friend, Beau Davis. His crime? Wearing a hat, which we covered previously.

The good news: The numbers of liberty-oriented people moving to and getting active in NH are growing, and those willing to take a risk are increasing. There is strength in numbers, and the more of us there are that are willing to laugh at the aggressors as well as noncooperate and disobey, the more they lose their precious legitimacy and control. The robed man in this video, Edward Burke, desperately attempts to flex his power by attempting to clear the courtroom.

The bad news: Burke is largely successful at clearing the court. With the exception of the Civil Disobedience Evolution Fund’s Jason Talley and myself, at least a dozen activists dutifully leave the room, some slower than others, but ultimately they all reluctantly clear out. All of this after Burke merely “asked” them to leave. Of course, the men with guns misinterpret what Burke says, and crank up the intimidation. My pointing this out to those leaving was insufficient to convince them to stay.

Everyone has their own personal reasons to leave, and I would not question individual circumstances. Everyone has a time when it will be right for them to say “No”. Learning to noncooperate takes time and effort, and I’m certainly a novice myself, but Talley and I as well as Pete Eyre, who stayed the longest of the group that left, have some experience at it.

More good news: Witness the scene outside in the court lobby. It was only a few years ago where seven activists were arrested in this very same lobby by Keene Police and charged with “Disorderly Conduct”, the aggressors’ favorite catch-all. Now, in 2011, the lobby is loaded with people – the numbers are larger than before, and when Keene police show up, they are unwilling to do anything more than have a chat with activists. This is progress, and kudos for the activists for making a stand here – not to mention for recording despite the unsigned order on the wall that for years has banned recording video in the lobby.

Back to the earlier scene in court, though. What would have happened if everyone in that courtroom stayed? After all, the robed man clearly wasn’t willing to pick anyone out to target them for removal. If he wanted a specific person gone, he could have made that happen, but he figured he’d try to get everyone to go. It worked, but what if it didn’t? He had left the courtroom, so in theory no one there could be charged with contempt (bailiffs don’t have this “power”), as he had not threatened them with it, as he did earlier with Beau over the hat. He told Beau that if he comes back into court after his “recess” and Beau still had the hat on, that he would be charged with contempt. The crowd was given no such ultimatum. They were only asked to leave so Burke could continue the sham hearing without being laughed at.

Sure, the handful of security guards could have arrested people under direction of the Sheriff’s captain Trevor Croteau, but that would have been a time-consuming hassle and would have resulted in another dozen trials for the already overburdened court. Of course, that hasn’t stopped them from aggressing in the past, as in 2010 a dozen of us were arrested for trespassing at the jail, but that was AFTER more than 30 people left the jail grounds once they heard that the police were en-route. What if all 30 had stayed? I bet no one would have been arrested.
Numbers are the critical factor in achieving liberty. Because only a minority of activists are willing to risk caging at this time (of course, everyone interacting with violent bureaucrats is constantly at risk, but some things are riskier than others), we need larger pools of activists so the numbers of those who refuse to obey will grow. Right now there are probably a few dozen total known activists in this area. I look forward to the day when that court is packed with 100+ people and most of them refuse to do as is “asked”.

Invitation by Spud Noone to the “Anti-House Stealing Party” in Massachusetts

I met Spud (above) at PorcFest last week. He had the bright idea to visit the Porcupine Freedom Festival to recruit activists to help protect a man’s property against seizure by the State of Massachusetts. Over a dozen answered the call including CD Evolution Directors Ian Freeman and Mark Edge.

at 10am-ish The town of Palmer will be sending out people to evict Jay Noone from his property. This is all based on a judgment that was not even signed by anyone, let alone a judge!! Please be there at 9 O’clock to support Jay. This event is meant to be a civil disobedience event in attempt to help Jay keep his property, or at least have enough witnesses there in the event of a strong reaction by the town to peaceful people.
