John Arnold to Retire from Superior Court

Ian Freeman recently learned, thanks to his incarceration, that Cheshire County Superior Court Judge John P. Arnold will be retiring. Our man on the inside was not able to learn the dates of John’s retirement and my followup calls to the Superior Court in Keene didn’t yield any answers, but Barbara Hogan, the clerk of the court, did confirm that John is retiring.

On Friday’s Free Talk Live, Ian Freeman called in and spoke to Mark Edge and myself about the news and reminded us about John’s time on the bench:

Ian called the retirement “convenient” since John would have faced a hearing by the Redress of Grievance panel for his banning of all recording devices, which is in violation of the New Hampshire open records statutes. John P. Arnold banned people from wearing shirts with messages on them, demanded that court watchers withhold display of emotion in the courtroom and forced people in the courtroom to stand for him, stifling their convictions (religious and otherwise). According to the State of New Hampshire’s website:

There are now 18 fulltime judges [at 11 locations] serving on the Superior Court throughout the state. Under the State constitution, the Governor, with approval of a majority of the Executive Council appoints judges who hold office until they attain the age of 70.

Dave Ridley continues to illustrate the episode of Free Talk Live that took place the evening of Ian’s caging by John Arnold in his latest report:

Despite being locked away at the Cheshire County House of Corrections, it’s good to see that Ian was still able to scoop the mainstream media. There’s no doubt the “State of New Hampshire” will fill this position and we’ll have yet another Superior Court Judge in Keene, NH. The governor will nominate a new judge (with the agreement of an executive council) so there won’t be a delay in enforcing bad laws and enriching the state with new fines.

Note that this governor is not friendly to the Free State Project and may use this as an opportunity to send a message to the people who move to “New Hampshire’s Liberty Activism Destination.” Harsher enforcement of bad laws will just serve as more opportunities to tell people about the peaceful civil disobedience happening in Keene as more people move here and say no to aggressive government. Since Ian’s caging, several people have moved and many more have publicly announced that they will be moving as a result. This is exactly what Ian had hoped for and as he put it, “it was worth it!!”

John has punished a lot of people during his time on the bench but I’m only aware of three liberty activists that faced him in court: Russell Kanning, Jim Johnson and of course Ian Freeman. Another high profile incident during John P. Arnold’s tenure as Judge was the suicide by self-immolation on the sidewalk outside where Arnold and his staff go to work in the Keene community. Like this, the news was released first by FreeKeene.com. Cases such as these receive more publicity because they take place in a city that Ian Freeman calls the “liberty media capitol of the world.” As more people have become aware of John’s harmful use of judicial powers he has become open to more scrutiny. His response was to ban cameras and other electronic devices that concerned members of the community use to hold public servants accountable.

There’s no way to know why he is retiring but if John P. Arnold’s August 8th Order to Media is any indication, he doesn’t care for transparency and the accountability that comes with it. His three pages of restrictions took place less than one month before the US District Court released a strongly worded opinion in support of recording public servants, like John. A key quote from the recent decision is in sharp contrast to the media crackdowns taking place in Keene area courts:

Gathering information about government officials in a form that can readily be disseminated to others serves a cardinal First Amendment interest in protecting and promoting “the free discussion of governmental affairs.”

Will the next Superior Court Judge be more camera-friendly, or will he and other public servants decide to resign when faced with accountability and a community in search of true justice?

Russell Kanning Kidnapped by Federal Marshalls… for chalking

WACO, TX – Russell Kanning was arrested/kidnapped by federal marshalls yesterday, July 5, for chalking a federal building in Waco, Texas.  Russell’s wife, Kat Kanning, reports that he is currently being held at the Jack Harwell Detention Center.


Take Action: Call 254.759.5900 to ask the U.S. Federal Government to release Russell Kanning and to check on this peaceful man’s safety.


He has a bond hearing on Monday at 2PM where Kat reports that “they will determine if there’s enough evidence to call a grand jury” for willfully damaging US Property of an amount not exceeding $1000 (a misdemeanor). Here is what Kat reported on NH Underground yesterday:

Russell’s in jail for writing ‘Free Naz‘ and ‘Free Bradley Manning‘ on the federal building in Waco. I was detained for about an hour also just for taking pictures. I don’t know where Russell is yet, or how long they’re going to keep him. [see update above] The feds erased all my pics. The district attorney (not sure if that’s the right office) cussed Russell out royally and acted like his hornet’s nest had really been stirred. I haven’t looked up phone numbers yet, but it was federal marshals who took Russell. They talked like they’d hand him over to Waco police, but I don’t know yet. I don’t know if anyone feels like helping, but Russell could use some phone calls on his behalf. He said this morning he’s going to start his prison ministry and try to help guys in prison find a better path.

Kat and Russell Kanning were my Free Grafton neighbors until they left to fulfill the Shire’s manifest destiny to expand westward. We sang together in the Peaceful Assembly Choir (video), constructed Grafton Gulch (video), opposed the United States presence in New Hampshire (video), and more.

Emperor Evan’s 2nd Wave Civil Disobedience

Ian Freeman, a fellow director of the Civil Disobedience Evolution Fund, had some nice things to say about Evan (pictured on the right with me and Bob “Weeda Claus” Constantine) at Free Keene.com to accompany a Liberty of Tour video featuring the Free Grafton Emperor:

If the first wave of liberty-lovers doing civil disobedience were people like Russell and Kat Kanning and Lauren Canario, with six heroic arrests under his belt, Evan Pierce may be the most prolific disobedient/noncooperative of the “second wave”. (New waves are necessary as each person can only take so many charges before life gets far more difficult, due to multiple convictions.) Evan’s actions are always very inspiring, as you will surely see. Evan moved to New Hampshire a few years ago from Austin, Texas and immediately jumped into the world of civil disobedience and noncooperation. This video covers his recent arrest at Grafton superior court for wearing a paper hat as well a prior arrest in Keene for smoking cannabis during Pumpkin Fest. Evan is one of the bravest activists in New Hampshire. If you love freedom, whether you are interested in civil disobedience, street theatre, media or politics, you should follow his advice in this video and move to New Hampshire! Peaceful Assembly Choir performs for Canaan Police Employees

The Peaceful Assembly Choir hasn’t been together for the last few weeks because Kat & Russell Kanning left the Shire to care for an ailing family member. They recently returned to Free Grafton and, starting with today’s free concert in the lobby of the Canaan Police Department, the choir is thrilled to be back performing every day until Christmas. Our next gig is at a Christmas Eve Shindig at Hoyt Park and on Christmas we’ll be celebrating ”Meatmus” with 40 other Shire Activists near Manchester. At each event we hand out printed copies of the Chronic Christmas Carols to encourage participation from everyone. We do this to raise awareness of the State’s agression against our peaceful Free Grafton neighbor and friend, Robert “Weeda Claus” Constantine.

At 3PM today I was joined by Kat, Russell, Evan and Rich to sing in the lobby of the Canaan Police Department. Kira Dillon was cool enough to take video for Talley.TV so I could perform with the choir. This holiday season we’ve performed to many receptive gatherings but today’s audience was special because if anyone needed to hear the messages contained in the songs composed by Richard Onley, it is the men employed by the Canaan Police Department. Sadly, on September 4th, 2009 these men trespassed on Bob’s private property to kidnap him and steal some of his “illegal” plants. Bob talked to Talley.TV about his experience:

I looked out around the corner of my house and there were a couple of police cruisers, or actually SUVs and some other vehicles in my driveway. I walked out into the yard and was met by one of the police officers who said, “We have a warrant.” I was led around my property. There were 7 police officers here. It’s not a very nice experience to have the peace and solitude of your home broken. This is my home, or at least I thought it was. They came here. I’ve never hurt anybody. They went through my house, went through all the dresser drawers, went through all that kind of stuff. The end result was I was taken to Canaan, NH police station – you know, the mug shot, the fingerprints, the whole bit.

Bob continues to describe the individuals employed by the Canaan Police Department who aggressed against him:

The real criminals are the people who came to my house, 7 armed men. This is a peaceful place. They took my life away from me and they don’t want to admit it. They say they’re just doing their job. I don’t buy that. People need to have personal responsibility and hold to that. I feel like I’m the victim here. I have been victimized, and so have my family, and so have my friends. It’s wrong, what they’re doing. Putting people like me in jail doesn’t do a darn thing. Are they going to correct me? I have my moral bearings. I know right from wrong.

As peaceful people who care about justice, the choir hopes to raise awareness about an agressive police department that continues to kidnap people for growing plants on their own property. The State can’t produce a single person victimized by Robert Constantine. Actually, thanks to the efforts of the employees of the Canaan Police Department, Bob IS the victim.

Speaking of aggression, Sergeant Todd Baravalle (pictured) pushed 19 year-old Kira Dillon while she was filming the choir for Talley.TV. Instead of asking her to move out of the way so he could close a door he put a hand on her. Todd looks like he weighs over 200 lbs, while Kira weighs less than 100. Ironically, this happened during the choirs performance of Violent Blight to the tune of “Silent Night:”

Violent blight.
Horrible plight.
Decent folks live in fright–
Not of hoodlums who murder and steal,
But of laws implemented with zeal.
Laws do more harm than dru-ugs.
La-aws do more harm than drugs.
Violent blight.
Horrible plight.
Does it work?  No, not quite.
Millions forced into programs like D.A.R.E.
Drugs abound, and are found ev’rywhere.
Just admit it, you’ve fai-ailed.
Ju-ust admit it, you’ve failed.
Violent blight.
Horrible plight.
No debate–black and white.
Prohibition fell flat once before–
Now it’s mushroomed a thousand times more.
End the Drug War toda-ay.
E-end the Drug War today.

Todd, according to his biography on canaanpolice.com, was a school resource officer so it’s likely that he didn’t care for our critique of D.A.R.E. But that’s still no reason to push a girl acting peacefully.
